Orange Rides – Terms & Conditions

Welcome to Orange Rides! These Terms and Conditions (“Terms”) govern your access to and use of the Orange Rides platform, services, and website (collectively, the “Platform”).

By accessing or using Orange Rides, you agree to be bound by these Terms. If you do not agree, you must stop using the Platform immediately.

Orange Rides is a ride and vehicle listing platform only. We provide a space where ride owners can publish listings and where customers can discover and connect with those listings. We are not a transport company, broker, agent, or booking service and do not provide transportation services ourselves.

1. Eligibility & User Accounts

1.1 Minimum Age – You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use Orange Rides.

1.2 Account Creation – To access certain features, you must create an account. You agree to provide accurate, complete, and up-to-date information during registration and keep it updated.

1.3 Account Security – You are solely responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Orange Rides is not liable for unauthorized access caused by your negligence.

1.4 Non-Transferability – Accounts are personal and cannot be sold, transferred, or shared.

1.5 Verification – Orange Rides reserves the right to request additional information or documentation for verification, especially for ride owners. Accounts may be suspended until verification is completed.

2. Use of the Platform

2.1 Permitted Use – You may use Orange Rides only for lawful purposes, in compliance with these Terms and applicable laws.

2.2 Prohibited Activities – You must not:

Post false, misleading, or fraudulent listings.

Use the Platform for illegal activities (e.g., scams, trafficking, money laundering).

Interfere with or disrupt the security or functionality of the Platform.

Copy, scrape, or harvest data for commercial purposes without written consent.

Upload harmful code, bots, or attempt unauthorized access to Orange Rides.

2.3 No Guarantee of Listings – Orange Rides does not guarantee the availability, accuracy, or quality of any ride listing.

3. Ride Listings & User Responsibilities

3.1 Ride Owners:

Are fully responsible for the accuracy, completeness, and legality of their listings.

Must ensure that listed vehicles are safe, roadworthy, and compliant with all applicable laws.

Are solely responsible for all agreements, interactions, and transactions with customers.

Must comply with Orange Rides’ subscription/payment policies.

3.2 Customers:

Must carefully review listings and independently verify details before engaging with ride owners.

Are solely responsible for evaluating the safety, legality, and suitability of any ride.

Understand that Orange Rides does not verify or endorse ride listings.

3.3 Orange Rides’ Role:

Orange Rides is not a party to any transaction between ride owners and customers.

Orange Rides may moderate or remove inappropriate listings but has no obligation to do so.

4. Subscriptions & Payments

4.1 Subscription Requirement – Ride owners must purchase an active subscription (weekly, monthly, or yearly) before their rides can be listed.

4.2 Fees & Billing – All fees are non-refundable unless expressly stated. Orange Rides reserves the right to adjust subscription fees with prior notice.

4.3 Direct Transactions Between Users – Orange Rides does not process or facilitate payments for rides between customers and owners unless expressly introduced in future features.

4.4 Future Payment Services – If Orange Rides introduces payment processing, such services will be subject to additional terms.

5. Disclaimers & Limitation of Liability

5.1 Platform Only – Orange Rides is a listing service. We do not operate, own, or control any rides, nor do we verify or guarantee them.

5.2 No Warranty – The Platform is provided “as is” without warranties of any kind, express or implied, including merchantability, reliability, or fitness for a particular purpose.

5.3 User Risk – You acknowledge that:

Orange Rides does not control the actions of ride owners or customers.

Any ride you book, rent, or engage with is entirely at your own risk.

Orange Rides is not liable for accidents, delays, fraud, damages, cancellations, or disputes.

5.4 Maximum Liability – To the fullest extent permitted by law, Orange Rides’ total liability for any claim related to your use of the Platform is limited to ₦0 (zero naira).

6. Content & Intellectual Property

6.1 Platform IP – Orange Rides owns all rights to the Platform’s design, software, trademarks, and content (excluding user-generated listings).

6.2 User Content – By posting listings or content (e.g., photos, text), you grant Orange Rides a worldwide, royalty-free, non-exclusive license to use, display, promote, and distribute such content on the Platform.

6.3 Content Moderation – Orange Rides reserves the right (but not obligation) to edit, suspend, or remove any content that violates these Terms or applicable laws.

7. Account Suspension & Termination

7.1 By Orange Rides – We may suspend or terminate accounts without notice if users:

Violate these Terms,

Engage in fraud, abuse, or harmful behavior, or

Threaten the safety or integrity of the Platform.

7.2 By User – You may request account deletion at any time through your profile settings.

7.3 Effect of Termination – Upon termination, your access to the Platform ends, but Orange Rides may retain necessary data as required by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Orange Rides, its founders, staff, and affiliates from any claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising from:

Your use of the Platform,

Your interactions with other users, or

Your violation of these Terms.

9. Governing Law & Dispute Resolution

9.1 Jurisdiction – These Terms are governed by the laws of the Federal Republic of Nigeria.

9.2 Disputes Between Users – Orange Rides is not responsible for resolving disputes between ride owners and customers. Users must settle disputes independently.

9.3 Disputes with Orange Rides – Any disputes involving Orange Rides must be submitted exclusively to the courts of Nigeria.

9.4 Class Action Waiver – You agree not to participate in any class action or representative proceeding against Orange Rides.

10. Updates to Terms

Orange Rides may update these Terms periodically. Any updates will be effective once published on the Platform. Continued use of Orange Rides after updates means you accept the revised Terms.
